Short answer: In occupancy certificate vs completion certificate, the OC says a building is fit to live in, with water, sanitation and power; the CC says the project was built to the sanctioned plan. Since a December 2024 Supreme Court ruling, utilities connect only buildings with one, so taking possession of a Bengaluru flat without an OC is a real risk.
- OC = fit to occupy. CC = built to plan. RERA defines both, "by whatever name called".
- The Supreme Court (17 Dec 2024) directed that electricity, water and sewerage connections be given only after the completion or occupancy certificate is produced.
- The same ruling asks for a builder's undertaking to hand over possession only after the certificate.
- The OC exemption is narrow: residential buildings on plots up to 1,200 sq ft, ground plus two or stilt plus three floors, in GBA limits. Apartment complexes aren't covered.
- A possession letter is not an OC.

You've been offered the keys. The flat looks finished, the builder says the OC is "in process", and your rent is due. This page explains what the two certificates are, where to check them, and what you're risking if you move in before the OC.
It sits inside a bigger set of checks, listed in order in property legal checks, from title to OC.
What's the difference between an OC and a CC?
RERA defines both in section 2. The MoHUA FAQ on the Act puts the difference simply (MoHUA RERA FAQ, Q14):
| Occupancy certificate (OC) | Completion certificate (CC) | |
|---|---|---|
| RERA definition | s.2(zf) | s.2(q) |
| What it certifies | The building can be occupied: it has water, sanitation and electricity and is habitable | The whole project was developed to the sanctioned plan, layout plan and specifications |
| Scope | The building or apartment | The entire project |
| Issued by | The competent authority | The competent authority |
| Why you care | Utilities, moving in, loans and resale | Whether what was built matches what was approved |
Both definitions cover a certificate "by whatever name called", so if a state issues one certificate that covers both, that's enough under the Act (same FAQ, Q13). The certificates come from the competent authority under local law, not from the builder or its architect (same FAQ).
Where can you check a project's OC and CC?
- On K-RERA. The Karnataka RERA Rules require the promoter to disclose an authenticated copy of the occupancy certificate and completion certificate (r.15(1)(E)(vi)) (K-RERA Rules). Find the project on the K-RERA project search and look in its documents. Our guide to checking a project on RERA shows where.
- From the builder. Ask for a copy of the OC itself, not a letter saying it's been applied for. It belongs in your file with the other property legal checks, from title to OC.
- From the city. OC applications in Bengaluru go through a registered architect or engineer on the BPAS portal, according to The Hindu (news).
The three-match OC check (our framework)
A copy of "an OC" isn't enough. It has to match three things.
| Match | What to compare | Why |
|---|---|---|
| 1. Building | Tower, block or phase named on the OC against your flat's tower in the agreement | Projects often get OCs tower by tower |
| 2. Plan | Plan or approval number on the OC against the sanctioned plan | An OC for a different plan doesn't cover extra floors or units |
| 3. Issuer | The authority that signed it | It should come from the competent authority, not the builder's architect |
Three matches: you have an OC for your flat. One miss: ask your lawyer before you take the keys.
What does the Supreme Court ruling say?
In Rajendra Kumar Barjatya v. U.P. Avas Evam Vikas Parishad (17 Dec 2024), the Supreme Court issued directions to all states (judgment, para 21). Two matter most to buyers:
- Direction (i): when building permission is given, the builder gives an undertaking that possession will be handed to owners only after the completion or occupation certificate is obtained.
- Direction (iv): electricity, water supply, sewerage and other service connections are to be given only after the completion or occupation certificate is produced.
The same ruling says the certificate should be issued without undue delay after inspection if the building matches its plan, and deferred until any deviation is fixed. Bengaluru's civic body began checking documents for new connections after the ruling (The Hindu, above).
What happens if you take possession without an OC?
- Utilities. Under direction (iv), a building without an OC or CC may not get permanent water, power and sewerage connections. Ask exactly how the flat is supplied today, and on what basis.
- Loans. Lenders may hold back the final disbursement or decline the property. Ask your bank in writing.
- Resale. A future buyer, and their bank, will ask for the OC. The same goes for the khata: see A-Khata vs B-Khata vs e-Khata.
- Your RERA claim. If the possession date on RERA has passed, you may have a claim for delay interest under section 18. Whether an offer of possession without an OC counts as valid possession is a question for your lawyer. Our guide to delayed possession: refund vs interest explains the choice.
- Deviations. Under the ruling, an OC is deferred until deviations are rectified. If the building has floors or units beyond the plan, the OC may not come at all.
Who is exempt from the OC rule?
Karnataka issued an order exempting small residential buildings in GBA limits from the OC: buildings up to ground plus two floors, or stilt plus three, on plots up to 1,200 sq ft (The Hindu, 15 Oct 2025, news). The Indian Express reported that it was issued under s.241(7) of the Greater Bengaluru Governance Act, applies to buildings with an approved plan, and that the cabinet later extended a similar exemption to other municipalities (Indian Express, news).
Worked example 1: does the exemption cover this building?
| Building | Plot | Floors | Exempt? |
|---|---|---|---|
| Individual house, approved plan | 30×40 ft = 1,200 sq ft | Ground + 2 | Yes, on the reported terms |
| Individual house, approved plan | 30×40 ft = 1,200 sq ft | Ground + 3 | No: above G+2 (and not stilt + 3) |
| Individual house, approved plan | 40×60 ft = 2,400 sq ft | Ground + 2 | No: plot above 1,200 sq ft |
| Apartment block | Any | Any | No: it isn't a small residential building on a 1,200 sq ft plot |
If you're buying a flat in an apartment project, assume the OC is required.
Which other approvals should a high-rise have?
Fire safety is the big one. Since 24 Mar 2023, anyone proposing to construct a high-rise building in Karnataka must get a no-objection certificate from the Karnataka State Fire and Emergency Services, and a high-rise is a building 21 metres or above in height, whatever its use (Karnataka Fire Force Act s.13(3), inserted by Act 24 of 2023).
Worked example 2: is this building a high-rise?
Illustrative, assuming 3 m from floor to floor and measuring height from ground level. Your architect will measure it the way the rules define it.
| Floors | Approximate height | 21 m or above? |
|---|---|---|
| Ground + 4 | 5 × 3 m = 15 m | No |
| Ground + 6 | 7 × 3 m = 21 m | Yes, at the threshold |
| Ground + 14 | 15 × 3 m = 45 m | Yes |
For a building at or above 21 m, ask for the fire NOC alongside the OC. Other approvals by building type and height (lifts, environment and so on) depend on the project, and we haven't listed them here because the thresholds vary.
Can a flat be registered without an OC?
We haven't found an official Karnataka rule that bars registering a flat's sale deed without an OC. That doesn't make it safe: the utility, loan and resale problems above apply whether or not the deed is registered. Ask your lawyer before you register a flat that has no OC.
What's the difference between a possession letter and an OC?
A possession letter comes from the builder and says you can take the flat. An OC comes from the authority and says the building can be occupied. Only the second is a legal certificate. Our answer on possession letter vs OC goes further.
What should you do if you're offered possession without an OC?
- Ask for the OC in writing, and the date it was applied for on BPAS.
- Check K-RERA for an uploaded OC and the declared completion date.
- Ask how water, power and sewerage are connected now, and whether they're permanent.
- Ask your bank whether it will release the final disbursement without an OC.
- Don't sign anything that waives your RERA rights or accepts possession "as is".
- If the RERA date has passed, talk to your lawyer about section 18 before you accept the keys.
- Put it in writing. Every promise about the OC should be an email or a letter, with a date.
Who fixes defects after possession?
Under section 14 of RERA, the promoter is liable for structural and certain other defects for five years from handover, and must fix a reported defect within 30 days, failing which you're entitled to compensation (MoHUA FAQ). Report defects in writing with photos. Our answer on structural defects after possession covers the process.
What mistakes do buyers make with OC and CC?
- Accepting a possession letter as proof. Ask for the OC.
- Checking "an OC" without matching the tower. Phased projects get OCs in parts.
- Assuming the 1,200 sq ft exemption covers flats. It doesn't.
- Moving in on temporary power and water without asking what happens next.
- Signing an "as is" possession letter that weakens your RERA claim.
OC and CC checklist
- [ ] OC copy in hand, not a "process" letter
- [ ] Three matches: building, plan, issuer
- [ ] OC uploaded on K-RERA, or a dated reason why not
- [ ] CC for the project, or the date it's expected
- [ ] Fire NOC if the building is 21 m or above
- [ ] Permanent water, power and sewerage connections confirmed
- [ ] Bank confirms final disbursement
- [ ] No waiver of RERA rights in the possession letter
- [ ] Snag list with photos at handover

Frequently asked questions
An occupancy certificate, defined in section 2(zf) of RERA, says a building or apartment can be occupied: it has water, sanitation and electricity and is habitable. It's issued by the competent authority under local law, not by the builder. In Bengaluru, OC applications go through a registered architect or engineer on the BPAS portal.
The OC relates to occupying the building: civic services are in place and it's habitable. The CC, defined in section 2(q) of RERA, relates to the whole project and certifies it was developed to the sanctioned plan, layout and specifications. A state may issue one certificate covering both, which RERA accepts.
You can, but it's risky. A December 2024 Supreme Court ruling directs that electricity, water and sewerage connections be given only after the completion or occupancy certificate is produced. Loans and resale can also suffer. Ask for the OC in writing and talk to your lawyer before you take the keys.
On the project's page on the Karnataka RERA portal. The state RERA Rules require the promoter to disclose an authenticated copy of the occupancy and completion certificates. Ask the builder for a copy too, and check that it names your tower and matches the sanctioned plan number.
Not for all. Karnataka exempted residential buildings in GBA limits of up to ground plus two floors, or stilt plus three, on plots up to 1,200 sq ft, according to The Hindu. Reports say the building needs an approved plan. Apartment complexes and bigger plots still need an OC.
No. A possession letter comes from the builder and offers you the flat. An OC comes from the competent authority and certifies the building can be occupied. Only the OC is a legal certificate, and the Supreme Court wants possession handed over only after it's obtained.
Yes. Since March 2023, the Karnataka Fire Force Act requires anyone proposing to build a high-rise to get a no-objection certificate from the State Fire and Emergency Services. A high-rise is a building 21 metres or above in height, whatever its use. Ask for the fire NOC alongside the OC.
Five years from handover. Under section 14 of RERA, the promoter is liable for structural and certain other defects in that period and must fix a reported defect within 30 days; if it doesn't, you're entitled to compensation. Report every defect in writing, with photos and dates.
Lawyer note: The legal points on this page are general information, not legal advice. Consult a property lawyer before paying, signing, registering or taking possession.
