Goods and Services Tax (GST) in Indian real estate applies primarily to the construction service component of under-construction properties. When you purchase an under-construction home from a developer, GST is levied on the construction service provided prior to completion.

Does GST Apply to Ready-to-Move Properties?
No. Ready-to-move-in properties with an Occupancy Certificate (OC) or Completion Certificate (CC) are EXEMPT from GST.
If the entire consideration is paid after the issuance of the Occupancy Certificate by the competent local authority, the transaction is treated as a sale of immovable property, which falls outside the scope of GST under Schedule III of the CGST Act. However, ready-to-move homes still attract state Stamp Duty and Registration charges.
What Is Affordable Housing for GST Purposes?
To qualify for the concessional 1% GST rate, a residential unit must satisfy specific statutory criteria set by the GST Council:
- Metropolitan Cities (Bengaluru, Mumbai, Delhi-NCR, Chennai, Kolkata, Hyderabad): Carpet area up to 60 sq. metres (approx. 645 sq. ft.) AND total property cost up to ₹45 Lakhs.
- Non-Metropolitan Cities: Carpet area up to 90 sq. metres (approx. 968 sq. ft.) AND total property cost up to ₹45 Lakhs.
GST-Inclusive vs. GST-Exclusive Pricing
A common pitfall for homebuyers is adding 5% GST to a builder's price quote that already includes GST. Always check your developer's demand letter or cost breakdown sheet:
- GST-Exclusive Quote: Base price = ₹1.00 Crore. GST @ 5% = ₹5.00 Lakhs extra. Total paid = ₹1.05 Crore.
- GST-Inclusive Quote: Total quoted price = ₹1.05 Crore. Embedded base price =
₹1.05 Crore ÷ 1.05 = ₹1.00 Crore. Embedded GST = ₹5.00 Lakhs. Do not add another 5% on top!
Builder Demand Letter Verification Checklist
Confirm whether the developer has received the Occupancy Certificate (OC/CC) before signing the agreement.
Ensure the cost sheet explicitly specifies whether the basic square-foot price is GST-inclusive or GST-extra.
If carpet area is under 60 sqm and price is under ₹45L, ensure the builder charges 1% instead of 5%.
Confirm that Stamp Duty and Registration fees are listed separately and not subjected to GST.

Do I have to pay GST on land or plot purchases?
No. Transfer of bare land or plotted developments is exempt from GST, as land sale is not a supply of goods or services under the CGST Act.
Can I claim Input Tax Credit (ITC) as a homebuyer?
