Is GST Applicable on Property Purchase?

Goods and Services Tax (GST) in Indian real estate applies primarily to the construction service component of under-construction properties. When you purchase an under-construction home from a developer, GST is levied on the construction service provided prior to completion.

Residential Real Estate GST Rates (1% vs. 5%)

Under the real estate GST regime effective since April 1, 2019:

Property Category Statutory Rate (With 1/3 Land Abatement) Input Tax Credit (ITC) Availability
Qualifying Affordable Housing 1% Effective GST Rate No Input Tax Credit (ITC)
Standard Residential Housing 5% Effective GST Rate No Input Tax Credit (ITC)
Commercial Property (Shops/Offices) 12% Effective GST Rate Subject to specific ITC rules

Does GST Apply to Ready-to-Move Properties?

No. Ready-to-move-in properties with an Occupancy Certificate (OC) or Completion Certificate (CC) are EXEMPT from GST.

If the entire consideration is paid after the issuance of the Occupancy Certificate by the competent local authority, the transaction is treated as a sale of immovable property, which falls outside the scope of GST under Schedule III of the CGST Act. However, ready-to-move homes still attract state Stamp Duty and Registration charges.

What Is Affordable Housing for GST Purposes?

To qualify for the concessional 1% GST rate, a residential unit must satisfy specific statutory criteria set by the GST Council:

GST-Inclusive vs. GST-Exclusive Pricing

A common pitfall for homebuyers is adding 5% GST to a builder's price quote that already includes GST. Always check your developer's demand letter or cost breakdown sheet:

Builder Demand Letter Verification Checklist

Check 01
Check OC Status

Confirm whether the developer has received the Occupancy Certificate (OC/CC) before signing the agreement.

Check 02
Verify Inclusive vs Exclusive

Ensure the cost sheet explicitly specifies whether the basic square-foot price is GST-inclusive or GST-extra.

Check 03
Verify Affordable Eligibility

If carpet area is under 60 sqm and price is under ₹45L, ensure the builder charges 1% instead of 5%.

Check 04
Separate Stamp Duty

Confirm that Stamp Duty and Registration fees are listed separately and not subjected to GST.

Frequently Asked Questions

Do I have to pay GST on land or plot purchases?

No. Transfer of bare land or plotted developments is exempt from GST, as land sale is not a supply of goods or services under the CGST Act.

Can I claim Input Tax Credit (ITC) as a homebuyer?

No. Under the current 1% and 5% GST schemes for residential real estate, developers are not permitted to claim Input Tax Credit, and homebuyers cannot claim ITC on residential purchases.

Is GST applicable on resale flat purchases?

No. Resale flats are completed properties being transferred from an existing owner to a new buyer. Since completion has already occurred, resale transactions are completely exempt from GST.
