What Is TDS on Property Purchase?

Tax Deducted at Source (TDS) on property transactions is a withholding statutory mechanism under Indian income tax law. When buying immovable property above the specified statutory threshold from a resident seller, the buyer is required to deduct TDS from the sale consideration price and deposit it directly with the Income Tax Department on behalf of the seller.

Is TDS an Additional Cost for the Property Buyer?

No. TDS does NOT increase your agreed property purchase price. TDS changes how the payment is routed, not the total consideration amount.

Why Is the Stamp Duty Value Required?

Under tax rules, the applicable TDS base is determined as the higher of the Sale Consideration Price OR the Stamp Duty Value (government circle rate). If the stamp duty authority assesses the property value higher than the contract price, TDS must be calculated on the higher stamp duty value to comply with statutory provisions.
